Claimant’s MP had written to the tribunal on his behalf requesting clarification – that was legitimately considered a request for a review and in turn treated as an application for permission to appeal (under rule 41 of the Tribunal Procedure (First-tier Tribunal) (Social Entitlement Chamber) Rules 2008) – decision was legitimately set aside as internally incoherent – second First-tier Tribunal was able to correct that incoherence.
